According to the provisions of Section 4, an easementary right is a right possessed by the owner or occupier of the land on some other land, not his own, the purpose of which is to provide the beneficial enjoyment of the land. Alternatively, they argued that the rights were implied under Section 62 Law of Property Act 1925; and/or under the doctrine established by the leading case ofWheeldon v Burrows (1879) 12 Ch 31; and/or that the rights were created in consequence of the common intention between the seller and the Claimants when they purchased the land. /Width 625
